El abogado Gonzalo Romero, representante de la familia de Zoe \u2014la ni\u00f1a de cuatro a\u00f1os fallecida en el Hospital de la Madre y el Ni\u00f1o\u2014, brind\u00f3 detalles sobre el avance de la Investigaci\u00f3n Penal Preparatoria (IPP) y confirm\u00f3 que la causa busca determinar si existi\u00f3 una violaci\u00f3n al deber de cuidado que configure el delito de homicidio culposo.<\/p>\n<\/div>\n\n\n\n

Situaci\u00f3n judicial y exhumaci\u00f3n<\/h3>\n\n\n\n

Romero explic\u00f3 que, tras la presentaci\u00f3n del pedido de abocamiento ante el Juzgado N\u00b0 1 de Violencia de G\u00e9nero (a cargo de la Dra. D\u00edaz Marano), la causa pasar\u00e1 formalmente al Juzgado N\u00b0 2, bajo la \u00f3rbita de la Dra. Flamini, competente por la fecha del hecho (ocurrido el pasado 20 de septiembre).<\/p>\n\n\n\n

Entre las diligencias de prueba fundamentales, la semana pasada se procedi\u00f3 a la exhumaci\u00f3n del cuerpo de la peque\u00f1a y la posterior realizaci\u00f3n de la autopsia. Asimismo, la Divisi\u00f3n Homicidios de la Polic\u00eda de la Provincia requiri\u00f3 la historia cl\u00ednica completa del centro de salud. Se espera que en las pr\u00f3ximas horas la querella tenga acceso formal al expediente y a los resultados del informe forense oficial, junto con la evaluaci\u00f3n del perito de parte convocado por la familia, el Dr. de la Colina.<\/p>\n\n\n\n

El foco en la atenci\u00f3n m\u00e9dica<\/h3>\n\n\n\n

La hip\u00f3tesis principal de la querella radica en analizar la atenci\u00f3n brindada a la ni\u00f1a tanto en la primera consulta ambulatoria como durante su posterior internaci\u00f3n en observaci\u00f3n.<\/p>\n\n\n\n

Seg\u00fan el relato de la madre, en una primera instancia no se otorg\u00f3 un criterio de internaci\u00f3n, indic\u00e1ndole el retorno a su domicilio. Ante el agravamiento del cuadro (v\u00f3mitos, deposiciones frecuentes y signos de deshidrataci\u00f3n grave), volvi\u00f3 al establecimiento, donde qued\u00f3 en \u00e1rea de observaci\u00f3n. No obstante, la querella se\u00f1ala que habr\u00eda existido una brecha horaria cr\u00edtica sin la intervenci\u00f3n ni supervisi\u00f3n de un m\u00e9dico pediatra de guardia, quedando el cuidado a cargo del personal de enfermer\u00eda.<\/p>\n\n\n\n

El letrado precis\u00f3 que se cotejar\u00e1 la historia cl\u00ednica con el informe de autopsia para determinar si la muerte (desencadenada por deshidrataci\u00f3n grave, falla renal y falla multiorg\u00e1nica derivada de una gastroenteritis) pudo haberse evitado mediante un diagn\u00f3stico o abordaje oportuno.<\/p>\n\n\n\n

Responsabilidad penal<\/h3>\n\n\n\n

En cuanto a los alcances jur\u00eddicos, Romero remarc\u00f3 que el derecho penal establece responsabilidades individuales. Por ello, la investigaci\u00f3n buscar\u00e1 individualizar el accionar del profesional o pediatra de guardia interviniente durante las horas determinantes, evaluando si existi\u00f3 negligencia e impericia en el deber de cuidado.<\/p>\n","protected":false},"excerpt":{"rendered":"
