La C\u00e1mara del Crimen hizo lugar al recurso presentado por el abogado querellante, el Dr. David Calipo, y resolvi\u00f3 revocar la absoluci\u00f3n dictada en primera instancia a favor del imputado en la causa que investiga un hecho de abuso sexual ocurrido durante el \u00daltimo Primer D\u00eda (UPD).<\/p>\n<\/div>\n\n\n\n

El caso, que gener\u00f3 conmoci\u00f3n en la comunidad educativa y social, dio un giro judicial decisivo luego de que el tribunal de alzada analizara los fundamentos de la apelaci\u00f3n presentada por la querella. Con esta resoluci\u00f3n, la justicia deja sin efecto el fallo firmado previamente por la jueza de primera instancia, el cual libraba de responsabilidad al acusado.<\/p>\n\n\n\n

En sus argumentos, la querella sostuvo que la resoluci\u00f3n inicial hab\u00eda incurrido en una valoraci\u00f3n deficiente e incompleta de las pruebas recabadas a lo largo de la instrucci\u00f3n, incluyendo testimonios clave y peritajes incorporados al expediente. La C\u00e1mara coincidi\u00f3 en que exist\u00edan elementos suficientes para revisar lo actuado y dar lugar al reclamo de la v\u00edctima y su representaci\u00f3n legal.<\/p>\n\n\n\n

El hecho investigado tuvo lugar en el marco de los festejos del UPD, una celebraci\u00f3n tradicional de los estudiantes del \u00faltimo a\u00f1o de la escuela secundaria que, en esta ocasi\u00f3n, qued\u00f3 empa\u00f1ada por la denuncia del grave delito contra la integridad sexual de la joven.<\/p>\n\n\n\n

Tras la revocaci\u00f3n del fallo absolutorio, la causa entra en una nueva etapa procesal. El tribunal deber\u00e1 disponer los pasos a seguir para reevaluar la situaci\u00f3n penal del imputado y determinar si se fija una nueva condena o se ordena la realizaci\u00f3n de un nuevo debate oral.<\/p>\n","protected":false},"excerpt":{"rendered":"
